General Terms and Conditions

1. Scope

These terms and conditions apply to all services offered via jimmox.ch. The provider is Ibrahim Smailagic, Web design nissa.ch, Hauptstrasse 23, 9476 Weite (hereinafter “we”). By placing an order, you accept these terms and conditions.

2. Free preview

Creating, viewing and editing a preview is free of charge and without obligation. Previews without an order are automatically deleted 7 days after the last change. There is no entitlement to a particular quality of the automatic import; you can add any content that was not transferred yourself.

You may only import your own website or use content for which you hold the necessary rights. Importing other people's websites is prohibited. You indemnify us against all third-party claims arising from content you use.

3. Conclusion of contract

By submitting the order form, you make a binding offer. The contract is concluded when we confirm the order by e-mail. We may reject orders without giving reasons.

4. Hosting subscription

• Price: CHF 49 per month. Setup is free of charge.
• Included are: hosting on our server in Switzerland, SSL certificate, updates, regular backups and the admin area for editing yourself.
• Small text changes by us are included up to approx. 30 minutes per month. Unused time expires and is not carried over. We will quote separately for larger work.
• Billing: the subscription is invoiced annually in advance – CHF 588 in the first year (12 × CHF 49), then the amount for the next 12 months each time. If you cancel after the minimum term during a year that has already been paid, we refund the amount for the full months after the end of the notice period.
• The minimum term is 12 months from going live. After that, the subscription can be cancelled at any time to the end of a month, with one month's notice. Cancellation must be made in writing or by e-mail.
• From the 13th month you choose between «Basic» for CHF 19.90 per month (hosting, SSL, backups, updates, admin area and a .ch or .li domain; without changes by us) and «Service» for CHF 49 per month (services as in the first year). We ask you before the end of the first year. Without a reply the plan continues as «Basic». You can switch for the following month. If you switch during a year that has already been paid, we settle the difference for the remaining full months (credit or additional payment).
• A new domain ending in .ch or .li is free in the first year and afterwards included in the plan price (Basic or Service) as long as the plan runs; we register it in your name. Domains with other extensions (e.g. .com) are charged from the first year at the domain prices then in force. You can bring an existing domain at any time; any transfer costs are not included.
• We ensure the most uninterrupted operation possible, but cannot guarantee constant availability (e.g. during maintenance or third-party outages).

5. Package for your own server

• Price: CHF 790 one-time. You receive the finished website with admin area as a package with instructions.
• You receive a simple, non-transferable licence for operation on one domain. You may change the content as you wish. Passing on, reselling or using the admin area for other websites is not permitted.
• Installation by us costs CHF 150 on request.
• Hosting, updates, backups and support are not included. The server must meet the technical requirements (including PHP 8.1 or newer). You are responsible for the operation, security and data backups on your server.

6. Online shop

• Price: setup CHF 1’500 one-off, plus shop hosting at CHF 49 per month, billed annually in advance. The minimum term is 12 months from going live. After that, shop hosting can be cancelled at any time to the end of a month with one month's notice; we refund the amount already paid for the full months after the notice period ends.
• Included: setting up the shop in the chosen design with your details, hosting on our server in Switzerland, SSL certificate, updates, regular backups and the shop admin area for editing yourself. The same rules as for the hosting plan apply to the domain.
• You are the seller and the contracting party of your customers. You are responsible for your products, prices, information, deliveries, warranty, your shop terms, privacy policy and legal notice, and for complying with the law (e.g. age limits, food law, VAT). The templates provided are samples and do not replace legal advice.
• Your customers' payments go directly to you (QR invoice to your account or online via your own account with a payment provider). We are not a party to these contracts and receive no commission. Payment provider fees are borne by you.
• We process your customers' order data only on your behalf for operating the shop (hosting); you are responsible for it.

7. Prices and payment

All prices are in Swiss francs (CHF). No value added tax is charged. Payments are due within 30 days of invoicing, unless paid online. For the hosting subscription, we invoice the fees in advance. In the event of late payment, we may block the website until payment is made after an unsuccessful reminder.

You can pay online via our payment provider Stripe, e.g. by card, TWINT or Apple Pay. Orders with a voucher, special offer or installation by us are paid by invoice.

Amounts in other currencies (e.g. euros or US dollars) that we show for guidance are non-binding conversions. We invoice exclusively in Swiss francs; any exchange rate and bank fees are at your expense.

8. Vouchers and special offers

• One voucher or special offer can be redeemed per order; they cannot be combined.
• Special offers are only valid until the stated date and while places are available. The time the order is received is decisive.
• Vouchers and special offers are not paid out in cash and are not applied retroactively to services already ordered or paid for.
• In case of misuse, e.g. several orders by the same person to use a special offer more than once, we may refuse vouchers and special offers.

9. Content and rights

You are responsible for the content of your website (texts, images, logo, information in the legal notice and privacy policy). The templates supplied for the legal notice and privacy policy are samples and do not replace legal advice. The domain and your own texts and images belong to you. Sample photos we use in the preview come from the image database Pixabay and may be used on your website under the Pixabay licence, but may not be resold individually. You may use logos from our logo generator freely; we do not check them for third-party trademark or name rights. The design and the program code remain our intellectual property. The footer of every website contains the note “Created with jimmox.ch”; it may not be removed.

10. Liability

We are only liable for damage that we have caused intentionally or through gross negligence, to the extent permitted by law. Liability for indirect damage, loss of profit and loss of data is excluded. With the package for your own server, we are not liable for damage arising from operation on your server.

11. Privacy

How we handle your data is explained in our privacy policy.

12. Changes

We may amend these terms and conditions. For existing contracts, changes apply if we notify you at least 30 days in advance and you do not object.

13. Applicable law and place of jurisdiction

Swiss law applies exclusively. The place of jurisdiction is the provider's registered office, unless the law mandatorily provides otherwise.
